asked the Secretary of State for Northern Ireland what criteria are applied by Her Majesty's Government to determine whether a Service man convicted of an offence committed in Northern Ireland and sentenced to imprisonment should serve his sentence in the part of the United Kingdom where the offence was committed, or elsewhere.

Under the Criminal Justice Act 1961 any convicted prisoner in Northern Ireland may apply to serve his sentence in another part of the United Kingdom. All such applications are considered sympathetically; various factors are taken into account in reaching a decision, including the prisoner's normal place of residence, his family circumstances and his personal safety. These criteria apply to all applicants, whether or not they are or were members of Her Majesty's Forces.
